TERMS OF USE

By entering the ALSTOM portal and using ALSTOM web sites, the portal user (“the User”) agrees to comply with the terms and conditions contained in this notice.

This portal is the exclusive property of ALSTOM Holdings, a ”Société Anonyme” with a capital of €624,125,422.20 formed and existing under the laws of France, registered in the Paris trade register under the reference number 347 951 238, whose headquarters are located at 3 Avenue André Malraux, 92300 Levallois-Perret, France (Tel. +33 1 41 49 20 00) referred to hereafter as “ALSTOM”. The web site’s publication manager is Mr Henri Poupart-Lafarge, Chairman and CEO of ALSTOM Holdings, who shall represent ALSTOM for all ALSTOM web sites located in France.

The hosting company, which is responsible for direct and permanent storage of the portal is ALSTOM Holdings whose registered office is at 3 Avenue André Malraux, 92300 Levallois-Perret, France (Tel. +33 1 41 49 20 00). The general architecture, as well as the software, content, live or still images, sounds, process, product, technology and know-how in general, and any other elements which are part of the portal are exclusive property of ALSTOM or its licensors. Any total or partial use, copying, reproduction, publication, downloading, posting, transmission or distribution of this portal in whatever manner, without ALSTOM 's express authorization, is prohibited, and shall be considered as an infringement of the relevant provisions of the French Intellectual Property Code, unless specifically authorized under applicable law.

ALSTOM, the ALSTOM logo and any derivative version thereof, as well as its partners' trademarks, whether or not owned by ALSTOM, are registered trademarks. Any total or partial reproduction of such trademarks and/or such logos, made through the portal without ALSTOM 's express authorization is prohibited in accordance with the relevant provisions of the French Intellectual Property Code.

Databases on the ALSTOM web sites, if any, are protected by the French Law of 1 July 1998 which transposes into the French Intellectual Property Code the European Directive of 11 March 1996 relating to the legal protection of databases. Any total or partial representation of these databases without the express authorisation of the site’s operator would constitute an infringement of rights.

Data Privacy
The data controller is ALSTOM Holdings. A declaration has been made to the French supervisory authority (the “CNIL”), number 741647 with respect to any automatic processing of personal data through the portal, in accordance with the provisions of French Law of 6 January 1978 “Loi Informatique et Libertés”, as amended. The User is hereby informed that personal data may be collected on the portal by ALSTOM and its world wide subsidiaries in accordance with Article 32 of the French Law of 6 January 1978, as amended. By becoming a registered User, or by responding to a survey or other request on our web site, the User acknowledges that he/she is voluntarily providing ALSTOM with personally-identifiable data about him/her (e.g., name, address, telephone number or e-mail address) ('Personal data').

ALSTOM may use such Personal data generally to respond to the User's inquiry, process orders or to provide the User access to specific account information. Settlement of Disputes and Applicable Law

The application of any rules of conflict of law which may restrict the full application of the French law are hereby excluded.

Therefore, French law is applicable to all internet surfers who browse the portal and use all or part of its functionalities.
